The length depends on your status and the type of contract.
For an open-ended contract (CDI), the probationary period is set as follows (art. 14):
- three months for executives and equivalent staff;
- one and a half months for employees;
- fifteen days for manual workers.
This probationary period may be renewed once only (art. 14).
For a fixed-term contract (CDD), it cannot exceed (art. 14):
- one day per week of work, up to a limit of two weeks, for contracts of less than six months;
- one month for contracts of more than six months.
Good to know: your contract, the collective agreement, or the internal regulations may provide for probationary periods that are shorter than these maximums (art. 14).
During this period, either party may terminate the contract without notice or compensation. However, after at least one week of work, if the termination is not due to serious misconduct on your part, notice is required: two days if you are paid by the day, the week, or the fortnight, and eight days if you are paid by the month (art. 13).
