What's the Legal Marriage Age in Morocco?

Legal marriage age in Morocco is 18 years for both sexes. Exceptions under 18 require judge approval with parental consent and medical/social investigation.

The legal age of marriage is set at 18 full Gregorian years, for both the man and the woman (art. 19). The law lays down a principle of equality here: the age is the same for both sexes. In addition to age, each person must be in full possession of their mental faculties (art. 19).

Marriage before the age of 18 remains possible, but on an exceptional basis. The family-affairs judge in charge of marriage may authorize it by a reasoned decision setting out the interest and the grounds justifying the marriage (art. 20). Before deciding, the judge must:

  • hear the minor's parents or legal representative;
  • have recourse to a medical examination or order a social investigation (art. 20).

Worth noting: the decision that authorizes a minor's marriage is not subject to any appeal (art. 20). On the other hand, the minor's marriage remains conditional on the approval of their legal representative, established by their signature and presence at the conclusion of the marriage; if the representative refuses, the judge rules on the matter (art. 21). Once married, the authorized minor girl or boy acquires the capacity to take legal action regarding the rights and obligations arising from the marriage (art. 22).
