Every consumer credit must be preceded by a written preliminary offer, so that you can assess the nature and scope of your financial commitment and the terms for performing the contract (art. 77). It is given to you free of charge in duplicate (art. 77). The lender is required to maintain the stated terms for at least seven days from this delivery (art. 77).
The preliminary offer must be clear and legible and must specify in particular (art. 78): the identity of the parties and of any guarantor, the amount of the credit, the nature, purpose, and terms of the contract, the itemized total cost of the credit, and where applicable its annual percentage rate as well as the file fees and the fees per installment (art. 78).
You have a cooling-off period: even after accepting the offer, you can reconsider your commitment within a period of seven days, thanks to a detachable form attached to the offer (art. 85). Exercising this withdrawal may not give rise to any recording in a file (art. 85).
Finally, advertising for a credit must be honest and informative, and must specify the identity of the lender, the total cost, the annual percentage rate, and the amount of the installments (art. 76).
