The basic rule: no more than once every three years. No increase may be agreed during a period of less than three years from the conclusion of the lease or from the last revision (art. 32). If you have not provided for any revision agreement, the rent may be revised after each period of at least three years (art. 33).
The increase ceilings (art. 34):
- 8% for premises used for residential purposes;
- 10% for premises used for professional purposes.
Special case of small rents: if the rent does not exceed 400 dirhams per month, it is the court that assesses the rate, without being able to exceed 50% (art. 35).
You and your landlord remain free to agree by mutual consent on the terms of revision, but without exceeding the rates set by law (art. 31 and art. 32). In the event of disagreement, it is the court of first instance that decides (art. 38). Good news: the new increase is not retroactive; it applies only from the legal action or the formal notice (art. 37).
